Teens Charged As Adults In Lauderdale Man's Murder

FT LAUDERDALE (CBSMiami) - Bail has been denied for two 14-years accused in the murder of a Ft. Lauderdale man.

Dallas Holston and Sedrick Joseph have been charged as adults. They both face a charge of second degree murder in the death of 52-year old Gary Martin. Holston has also been charged with possession of a firearm by a minor.

Holston's family attended Tuesday magistrate hearing. The teen's attorney said the "murder" charge was too strong.

"There's no probable cause as to murder in the second degree. This is as much manslaughter as it is second degree murder. Manslaughter, he would be entitled to bond as a matter of right," argued attorney Randall Haas

The judge did not budge.

The teens will now be transfered from a juvenile facility to one of Broward's jails for adults.

After the hearing Haas said given that fact that his client is just 14 and still in middle school, he should not be held in the adult jail.

"He's a little kid, he's a little kid and he's in a man's world. He's got no business being in there right now . I'm hoping we won't have him in there for much longer," said Haas.

"But this kid is accused of a serious crime," pointed out CBS4's Ted Scouten.

"Accused of a serious crime, yes he is. And it's an accusation, that's all it is right now," said Haas.

Martin was shot to death while sitting in his car on April 19th.

Surveillance video shows Martin's blue car heading out of an apartment complex at 2400 N.W. 22nd Street. On the video two males walk to the car, the vehicle stops and they get in.

Seconds later, Martin's driver's side door opens and one of the males gets out. A short time later he returns and then both males take off.

Surveillance cameras captured them running away while another camera shows the two males a short time later running with a third person.

Martin died from multiple gunshot wounds.
