FT LAUDERDALE (CBSMiami/AP) - A man left paralyzed after he was shot by Palm Beach County sheriff's deputy will be back on the stand Friday.

On Thursday, Dontrell Stephens testified that his hands were up and he was unarmed when he was shot by deputy Adam Lin in September 2013.

Lin claims Stephens, 22, had reached for his waistband and had thrust his left hand forward while holding a dark object, making him think he was about to shoot him.

Stephens says the shooting violated his civil rights and is seeking over $5 million in damages.

Stephens says he is in such constant pain he often finds himself crying. Lin has been cleared of criminal wrongdoing.
