Miramar Police Captain Suspended For Alleged Sexual Inspection Of Teen

FT. LAUDERDALE (CBSMiami) – A Miramar Police Captain is out of jail after being accused of making a teenage girl remove her clothing when he found her and a boy in a parked car.

Juan De Los Rios, 46, walked quietly out of the Broward County jail after posting his $30,000 bond. He never responded to the allegations against him.

De Los Rios is charged with two counts of lewd and lascivious conduct on a child under 16 by a person over 18. He's accused of making a 15-year-old girl remove her pants and underwear so he could check to see if she'd been having sex.

The charges stem from a January 18th incident at a Miramar parking lot.

Authorities say the 18-year veteran of the Miramar Police Force approached a car and began questioning a 15-year-old girl and a 19-year-old man in the back seat.

The girl says she told the officer they were just talking.

According to the arrest affidavit from the Broward State Attorney's Office, "the victim advised at one point the offender in the uniform crossed his arms and leaned against the window, looked at them, gave a long hard pause and stated, 'Well, are you having sex? What are you doing here?' The victim advised she and the witness both told the officer no, no, no Officer, no."

The affidavit alleges the officer told the victim he needed to see if they'd been having sex by inspecting her between her legs. The victim claims the officer even used a flashlight and had her expose her breasts looking for bruises. The victim says the officer never touched her.

The Miramar Police Department says "an administrative investigation is presently being conducted, which precludes the department from speaking further on the matter."

The victim waited a week to report the incident to Miramar Police. Authorities say she even waited to tell her parents because she was "scared" and "embarrassed".

De Los Rios is on unpaid leave as the investigation continues.
