KEY WEST (CBSMiami) – Newly released surveillance video is key in the civil case against Backstreet Boys singer Nick Carter.

The video captured Carter in a white baseball cap stumbling into the Hog's Breath Saloon in Key West on January 13th.

Carter is reeling and it does not take much time for bouncers to try to ease Carter out the door.

He did not go willingly and took on 21-year-old bouncer Skylar Carden.

Carden is now suing the former popstar.

"Nickolas Carter had already been kicked out of the Hog's Breath restaurant. Nickolas Carter would not take no for an answer and he started attacking Skylar Carden," said Carden's attorney, Mark DiCowden.

The video shows that a pushing and shoving melee ensued as Carter and Carden get into it.

Eventually Carter was arrested and did public service time.

Now faces the civil case.

"Skylar Carden was chocked for an inordinate period of time by Nickolas Carter. He was drunk at the time and he was trying to squeeze the life out of Skylar Carden," DiCowden said.

Carden looking for a judgement in excess of $15,000 and wants a jury trial.
