MIAMI (CBSMiami) - The verdict is in for a northwest Miami-Dade man who was charged with neglect after his son flew out of a moving car on Hallandale Beach Boulevard.

The jury found Roland Delancy, 27, guilty of child neglect. He is now facing five years in prison.

In August 2014, Delancy was with his girlfriend and their young son in a car when the couple got into an argument. According to his arrest report, Delancy's 3-year old son was sitting on his lap in the front passenger seat without a seat belt on.

When Delancy went to snatch a cell phone out of his girlfriend's hand, she swerved and slowed down. That's when Delancy reportedly decided he'd had enough.

When he opened the door to get out his son fell to the roadway in the middle of traffic. Delancy ran off and left the boy in the middle of the road where drivers hit the brakes in order to avoid hitting him. The child's mother stopped the car, scooped up her son and drove off.

During Delancy's trial, a couple who witnessed the fall took the stand as did Jasmine Simmons, the child's mother. She said she didn't see what happened, only her son getting up after he landed on the street.

Delancy will remain out on bond until his sentencing scheduled for February 26th.
