Crucial Legal Question Confronts Florida's Voucher Program

TALLAHASSEE (CBSMiami/AP) – The fate of the state's private school voucher program, which currently serves nearly 70,000 students, is being decided in a Leon County courtroom.

Opponents to the state's tax credit scholarship program squared off Monday against lawyers representing Florida parents of children enrolled in the program.

Judge George Reynolds must decide whether or not to throw out the lawsuit or to let it proceed to a trial.

Lawyers representing Gov. Rick Scott and the state argued that the groups who sued didn't have the legal right to file the lawsuit. The attorneys said the groups haven't shown any proof that the program is harmful.

But lawyers representing the state's school boards, as well as Florida's teacher unions, argued that program diverts money that would go to public schools.
