DAVIE (CBSMiami) – While most of the stories surrounding the text messages between Jonathan Martin and Richie Incognito have focused on the relationship between the two players, a secondary issue could put both players at risk of further suspension.

Incognito’s attorney, Mark Schamel, gave CBS4 40 pages of text messages between his client and Miami Dolphins offensive tackle Jonathan Martin. At multiple points in the texts, both Martin and Incognito refer to drugs.

On July 29, 2013, Incognito is exchanging texts with Martin and said, “Pop a couple Molly I’m sweeeeatin.”

On August 31, 2013, Incognito is trying to coax Martin to go out with him and two women when Martin writes, “My friend Mary Jane has me glued to the couch.” Incognito writes back, “F***** stoner. Take a shower and get ur a** down here. These bit**** are ready.”

Martin responds, “I’m staying in man. My liver can’t take anymore abuse.” Incognito texts back, “Me too,” before texting back about 90 minutes later, “Broooooo Ur missing out.”

Later in September 2013, the duo are exchanging messages again with Incognito texting Martin asking, “R u alive?” Martin responded, “Haha yeah. That was fun.” Incognito wrote back, “Hell yea Did u go to pouncey’s after? I’ll kill u if u did.”

Martin wrote back in two straight messages, “Lol hell no. No drugs for me rest of season.” Incognito texted back, “Goooood That s*** is ridiculous.”

CBS4 has reached out to the NFL for clarification about whether or not this would put the two players at more risk of falling into the substance abuse program. In addition, CBSMiami asked whether both players could be subject to punishment under the personal conduct policy. The NFL hasn’t responded to our inquiry yet.

The texts, overall, contained foul language, insults, frequent talk of hookers, prostitutes, strippers, sexual conquests, and various other topics.

Incognito’s attorney told CBSMiami that their client does not take and is not involved with drugs.

CBSMiami reached out to the Miami Dolphins on Friday seeking comment on the drug use talked about between the two players. Thursday, the Dolphins gave a statement to CBSMiami about the text messages obtained exclusively by CBSMiami. The statement read:

“Consistent with our organizational position, we are reserving further comment on this matter while the report is pending.”

Dolphins owner Stephen Ross let it slip this week that neither Martin nor Incognito are likely to return to the team in 2014. The Fins will make an effort to try to trade Martin to recoup something for using a second-round draft pick. Incognito became an unrestricted free agent when the season ended.

The team is also waiting on the independent investigation report from attorney Ted Wells that was looking into the harassment claims made by Martin against the Dolphins. Ross said he has a pretty good idea what’s in the report, but the report will note be released until after Super Bowl XLVIII.
