Man Accused Of Sexually Battering Woman Behind Bars

(CBSMiami) – A man accused breaking into an elderly woman's home late last month and sexually assaulting her has been arrested.

Miguel Chavez, 57, has been charged with sexual battery with force, burglary with assault, battery on a person over 65 years of age, battery on a police officer or fire rescue personnel and resisting arrest with violence.

It happened Tuesday, Sept. 24th, in the 1200 block of SW 23rd Street. The elderly woman told police she was asleep when a man, wearing only briefs and an undershirt around his face, broke into her home just after 5 a.m.

The man proceeded to climb on top of her and then began to choke her with one hand while he took off her underwear off with the other, according to the incident report. The man, whom she described as a Latin male, then removed the shirt from his face and began to masturbate as he kissed her, according to the incident report. The woman said he then sexually molested her.

"His actions were, I mean, so aggressive, choking her, ripping her clothes off, and fondling her and he also attempted to penetrate her," said Miami police Sgt. Freddie Cruz at the time.

Neighbors were stunned at why the woman was targeted in the first place.

"What kind of mentality do you have to break into an elderly woman's house," asked neighbor Vamshi Rojas.

Police say Chavez has a record which includes grand theft of a motor vehicle, burglary, possession of burglary tools and battery.
