FORT LAUDERDALE, Fla. (CBSMiami/AP) — A Broward judge is set to take up a potential conflict involving a member of the grand jury in the case of a deputy who shot and killed a man carrying an air rifle.

The defense attorney for suspended Broward Sheriff's Office Deputy Peter Peraza is seeking details about a grand juror whose daughter was arrested on drunken-driving charges before the case was presented to the panel. The question is whether the juror had a conflict in the Peraza case.

A hearing is set for Thursday in Broward Circuit Court.

Peraza faces up to 30 years in prison if convicted in the July 2013 killing of 33-year-old Jermaine McBean, who was carrying an unloaded air rifle. Peraza has pleaded not guilty.

McBean's family has filed a wrongful death lawsuit.
