Lawyer Denied Bond For Inmate She Reportedly Had Sex With

FT LAUDERDALE (CBSMiami) – Not a good day in court for Hollywood attorney who is representing a man she reportedly had sex with - while he was in jail.

Jessica Mishali David, 35, was prohibited from " entering any Broward Sheriff's Office facility or onto any BSO property" five days after she was allegedly caught having sexual intercourse with inmate 26-year old Ysreal Granda in a jail interview room.

Mishali has denied the allegations.

Since it was determined that no crime was committed, Mishali was allowed to return to the jail but could only speak with Granda if the two were separated by glass.

During a hearing Thursday a judge denied her bond request for Granda, a convicted felon who is currently charged with four felony counts, including two for attempted murder.  The charges stem from an October, 2012 shooting in Pembroke Pines in which Granda allegedly fired six shots into a car the mother of his 6-year-old daughter was riding in with another man.

Mishali argued, trying to speak to her client behind glass makes it difficult to work on his defense and retain attorney/client privilege.

"It's not just that we're behind glass," she said. "There's a lot of other issues, it's not just that they can read our lips, there is a video camera that feeds to a TV next door at the booth where the deputies are watching."

During the bond request hearing, Mishali argued that since the sex allegations arose he's been mistreated in jail and was afraid for his life.

"He is in a very scary situation, he's afraid for his life," Michali argued. "He is losing weight, he can't sleep.  He's scared all the time and deputies are directly threatening him. He has even been told, 'Don't forget I know where your mom lives.'"

The state countered that Granda, who reportedly planned "hits" from jail with family members, was dangerous and needed to remain in custody.

"As you know while he was incarcerated is when he arraigned for the contract kill of the victim in the Broward County case and the jail calls are extensive in regard to that case," said prosecutor Yael Gamm.

The judge agreed, denying the request.

"It would be an abuse of my discretion to put Mr. Granda on the street," said Broward Circuit Judge Ilona Holmes. "So your motion to set bond is denied."

Mishali also told the judge she could not effectively speak with Granda because they had to have the glass wall between them. The judge ruled that order would remain in place.

When Mishali was asked by reporters after the hearing if she wanted the glass partition removed just so she could be closer to Granda, she said, "No.  I would like to be able to prepare his case for trial. Those allegations are false!"

The Florida Bar was notified of the sex allegations.

If it is found that Mishali violated a rule of conduct, punishment ranges from a reprimand to loss of her law license.
