Miami Beach Officer Who Killed Bank Robbery Suspect Has Clean File

MIAMI BEACH (CBSMiami) - Miami Beach police have released the names of the officers involved in the deadly shooting of a bank robbery suspect over the weekend outside the Razzledazzle Barbershop shop on Alton Road.

Officer Fabio Cabrera who shot and killed Dave Winesett has been with the department since 2010 and has never had a complaint made against him. He received a lifesaving award in 2009 when he was a Pinecrest police officer. He won the same award earlier this year.

Sergeant Philip Elmore, who fired his Taser at Winesett's chest, has been with the department since 2006. More than a dozen complaints are listed on his personnel file. He has been discipline five times, the other complaints were cleared.

Elmore is back on regular duty. Cabrera remains on administrative leave.

Winesett, 51, was killed Saturday after he attempted to rob a bank. While fleeing police he armed himself with a straight razor inside the barber shop.

Barbershop employees told CBS4 that Winesett said he had been in jail for 20 years and that he was never going back.

When he went outside, he was confronted by police. Winesett waved that razor around and then pointed it at a female officer, that's when Elmore tased him, and Cabrera shot him with a high-powered rifle.

A CBS4 Investigation found that the officers may have violated department policy and procedure when they shot Winesett.

Winesett had been living in a halfway house in Little Havana to finish out the remainder of his prison sentence for a laundry list of charges including bank robbery in Florida.
