PALM BEACH (CBSMiami) – Another chapter in the Lohan family drama just wrapped up in a South Florida courtroom.

Michael Lohan and wife Kate Major Lohan appeared in court because of a recent argument in front of their young children.

Michael Lohan says he came home on October 11th after visiting a water park with his two young kids. He says he found his wife in his home, which was okay because she had permission to be there. But Michael Lohan says Kate Major Lohan was drunk. That set off a series of events that has the family's future back in the hands of a judge.

The two traded allegations in a Palm Beach County courtroom Tuesday. The couple appeared in front of Judge Moses Baker to sort through allegations related to that argument in front of their two young kids in early October.

After the hearing, Michael Lohan defended himself saying, "There was no domestic violence whatsoever."

Michael Lohan said he never laid on finger on Kate Major Lohan and that he's being kept from his kids because she showed up at his house intoxicated after he spent the day with their two young boys.

"I protected my kids," he said. "They go to the best schools. They go to the doctor. They have everything they need and all of sudden they're stripped from me because she showed up at my house drunk? Again?"

Michael Lohan's mother is in town from New York caring for the children in his home while he stays in a hotel, per court order. The judge in the case said both parents are failing to meet the standards of the court's orders regarding their care of their kids.

Meanwhile, Michael Lohan said he might ask ex-wife Dina, the mother of four of his children including Lindsay, to help with the children.

"My ex-wife Dina said she would take the kids," he said. "She's an amazing woman."

While Kate Major Lohan did not talk to us after the hearing, Michael Lohan says she has an alcohol problem and needs to get clean.

"I want Kate to get help," Michael said. "I want her to get long term help. I want to raise my children and I want them to have a healthy mother around."

Michael Lohan says he might ask that the kids move to New York with his mother. In the meantime, there are a lot of legal issues for this family to sort out.
