Canadian Consul's Son Denied Bond While Awaiting Murder Trial

MIAMI (CBSMiami) — Marc Wabafiyebazu, a 15-year-old facing felony murder and other charges as an adult, will have to remain behind bars according to a judge's ruling. And the judge had harsh words for his mother, Canadian Consul General in Miami, Roxanne Dubé.
A Miami-Dade judge decided Wednesday that Officer Juan Velez's account, who told the judge the teen admitted the boys' role in the crime as he drove him to jail, was "very credible."
Judge Teresa Pooler said she would be "loathe" to leave Marc in his mother's custody, implying she was not an involved mother.
"(Dubé) did not know where they had obtained $2800 dollars to get involved in this drug deal, she did not know where they had obtained guns and what impressed me the most, or did not impress me was that she was irresponsible enough to allow an 18-year-old teenager to drive a car with consulate plates," said Judge Pooler.
Wabafiyebazu faces felony murder and other charges as an adult in a March 30 shootout that killed his older brother and another teenager. Police say the slayings happened after the Wabafiyebazu brothers tried to rob marijuana dealers.

Marc Wabafiyebazu has pleaded not guilty. His mother has said she is convinced he is innocent and that if her son was released on bail she would ensure he remained in the U.S. and attended all required legal proceedings.
The judge also denied bond saying based on Marc's dual passports, and his mother's privileges in her powerful position, Marc is a flight risk. She added that she was doubtful he would be extradited back to the U.S. if he did flee to Canada.
Dubé declined to speak to the media after the hearing.
Marc's attorney Curt Obront did not comment on the judge's criticism of Dube, but added, "We still continue to have faith in our case, in our client, in our defense and we are continuing to move forward in that direction."
Obront also told CBS4's Natalia Zea that Marc was having an understandably difficult time in adult lock-up, saying Marc is the jail's youngest inmate.
