Judge To Rule On Resentencing For Teen Rapist, Murderer

MIAMI (CBSMiami) -- A South Florida judge will wait until Friday to decide whether a man sentenced to life in prison without parole when he was 14, will be given a lighter sentence.

There is no question 24 -year old Ronald Salazar will spend years in prison for raping and murdering his 11-year old sister, Marina. But because he was only 14-years old  at the time, he may soon be given a sentence he may never have thought possible,less than life behind bars.

It's been nearly a decade, but Salazar grimaced while watching his 14-year old self describe the vicious rape and murder of his sister Stephanie while she slept.

"I grabbed her like this and I went like three times," he said while moving his finger across his throat....I heard (gurgling) and like the blood everywhere," Salazar said in the video.

Salazar has spent the last 10 years in prison, sentenced to life without parole by the same judge he sits before now.

As a man he recounts his story of anger toward his family for abandoning him in El Salvador until he was 10.

"They wouldn't tell me the reason why they left me, why they contacted me," he told the court Monday.

It's the same sad complaint he told a homicide detective as a young teen.

"When I just got here, my dad said he was going to send me back to my country...I felt like they didn't love me," said Salazar.

Judge Ellen Sue Venzer has to decide whether or not to stand by her original state-mandated ruling, now that the U.S. Supreme Court has ruled minors sentenced to life must have a hearing to reconsider.

His attorneys are asking for a review of his case at the 25-year mark.

"The law says we have to look again. We have to look at his circumstances, have to look at his development and most importantly we have to look at his change," said defense attorney Laura Rojas.

Prosecutors argue Salazar's crime against Marina - a crime that can never be taken back- merits shackles for the rest of his life.
