Judge Dismisses Voucher Expansion Suit

TALLAHASSEE (CBSMiami/AP) — A lawsuit aimed at blocking the expansion of the state's main private school voucher program has been dismissed.

The lawsuit was filed earlier this year on behalf of the parents of three Miami-Dade students and a Lee County teacher.

in his ruling Chief Circuit Judge Charles Frances said that those who filed the suit did not show how the program would harm them.

The judge's ruling, however, doesn't end the legal battle. There's still a separate challenge pending to the program that pays to send children from low-income families to private schools.

But this lawsuit was being watched closely because it also jeopardized a new program that expands services to disabled children.

Legislators approved the expansion this year. The lawsuit contended legislators violated a constitutional requirement that bills must cover just one subject.
