Spike Lee Wants Federal Negligence Suit Dismissed

ORLANDO (CBSMiami/AP) – Movie director Spike Lee is looking to get a federal negligence lawsuit against him thrown out.

The lawsuit was filed by Elaine and David McClain who were forced to leave their home after the director tweeted their address and said it belonged to George Zimmerman, the man acquitted in the shooting death of Trayvon Martin.

The McClains, who are in their 70s, say they have a son named William George Zimmerman, who lived in their Sanford area home in the mid-1990s. They say he is no relation to George Zimmerman.

The McClains say they received death threats.

Lee's attorneys argue the lawsuit should be dismissed since the couple reached a $10,000 settlement with Lee last year.

The couple is seeking $1.2 million.
