No Manslaughter Charges Will Be Filed In Death Of Toddler At Hialeah Motel

MIAMI (CBSMiami) - The parents of a two-year-old boy, who died after falling from the window of his family's motel room, will not face manslaughter charges--but are facing child neglect and drug charges.

The death of the two-year-old has been ruled by the State Attorney's Office as an accident therefore the boy's parents, Luis Rodriguez, 26, and Jacqueline Sanchez, 27, will not face manslaughter charges.

The couple, however, are being charged with child abuse based on the narcotics found in the room which were accessible to the boy at the time of the incident.

The parents are also facing a charge for possession of cocaine, with intent to sell which is a  2nd degree felony, possession of ecstasy with intent to sell, also 2nd degree felony, and conspiracy to sell narcotics--a third degree felony.

Hialeah Police said they were called to the El Paraiso Motel on the night of September 13, and rescue units transported the young boy to Jackson Memorial Hospital. He spent several days there before he died.

Detectives said they learned the boy whom fell, a five-month-old boy, along with the boy's parents, were staying in the motel on the second floor and had been for two days.

Department of Children and Families took custody of the five-month-old boy. It's believed the children's parents were using cocaine and alcohol at the time the child fell, according to Hialeah Police.
