Judge Denies 'Toxic Tush' Accomplice Restraining Order
MIAMI (CBSMiami) – The man accused in connection with the so-called fix-a-flat fake doctor scandal was back in court Friday where a judge ruled against his request for a permanent restraining order against a woman who he said attacked him during a taping of the Christina Show on Telemundo.
The judge ruled the restraining order against Brunetta Brown would not be granted due to lack of evidence. Brown insisted in court Friday that she never threatened Corey Eubanks, who has been implicated as an assistant to Oneal Ron Morris, also known as "Duchess."
In his petition for a restraining order against Brown, Lewis cited the attack on the Christina show. Lewis also said two months ago, Brunetta Brown telephoned Eubanks and said, "I have someone who did 15 years in prison and won't mind doing 25 years for your life." She reportedly said she had "goons" who would hurt him.
Lewis's petition also said that four or five months ago, Brunetta Brown and her daughter Shaquanda drove to Eubanks's business and said she would have someone "run in your business" and hurt him.
The petition also said Shaquanda Brown spoke to Eubanks and said she was a detention deputy and said if Eubanks ever went to jail, she would have "one of her boys" hurt him.
The petition also says for the past nine months, Brunetta Brown called Eubanks more than 100 times, repeatedly leaving voice messages that she would harm him. Lewis told CBS4's Peter D'Oench that none of those calls were recorded.
"We take them (the threats) very seriously," said Lewis. "There are a lot of them, we're talking about people trying to harm him, people from prison."
"I didn't have no reason to threaten him, her, he, whatever at all," Brown told D'Oench in response.
"I never called him," Brown also testified in court. "I mean you're a man. Why am I going to beat you up. I have no reason to call him. I haven't seen or called him since I last saw him on the Doctor Phil show. I don't have Facebook or Twitter. There is no way I can contact Mr. Eubanks. And I never ever knew he had a place of business or where it was."
Morris allegedly injected Brown's daughter Shaquanda, and other women, with a near-lethal chemical formula to enhance their butts, only to find themselves sick and disfigured. Investigators said the concoction included Fix-A-Flat and Super Glue.
In court Friday, County Court Judge Carroll Kelly, who is the Administrative Judge for Domestic Violence, also cautioned Brown to be careful.
"Am I disappointed, the truth is going to come out. I'm not disappointed, I'm aggravated and this is aggravating," said Eubanks to D'Oench immediately after the hearing. "If I have to keep going through things to prove that I have nothing to do with the case, I'm getting threatened, it's aggravating. What do you mean 'why is it aggravating?' It was serious threats."
Brown said she was quite pleased with the outcome as she left the court.
"Threats were never made and I won the case. Victory. I feel great," said Brown.
D'Oench asked Brown why she felt the allegations were being made against her.
"So they could win the case," she replied.
Despite Friday's decision, the case is not over.
Eubanks attorney Jim Lewis said he plans to seek a permanent restraining order against Brown's daughter Shaquanda.
Lewis talked in court about the Cristina Show incident in which Eubanks said he was attacked by Brown and her daughter and set off an on-camera free-for-all. During the melee, security guards tried to separate everyone and Eubanks said Brown threw a prop syringe at him, which struck him in the forehead.
The Hollywood resident has denied any wrong-doing, and said he went on the Telemundo network to clear his name.
Eubanks filed a temporary restraining order against the Browns following the melee which was only in effect until Friday's hearing.
After the incident on the Cristina Show, Brown told CBS4 News she almost died after what she called a botched cosmetic surgery.
"It was a bad buttock in injection," said Brown. "He knows what he did. He almost took my life."
Brown, a mother of two, spent 38 days in the hospital.
When she appeared on the Spanish language show, she thought it was a show about fake cosmetic procedures.
But 20 minutes before show time, Corey Eubanks joined Shaquanda on the stage.
She said things got out of hand after Eubanks accused her of lying.
While Eubanks alleges Shaquanda's mother attacked him, Shaquanda said that's not true.
"He came after me. No one attacked him," said Shaquanda.
According to the police report, witnesses on the set aren't really sure who started the scuffle.
Both Morris and Eubanks are charged with practicing medicine without a license.
They have both pleaded not guilty and are out on bail while their cases move forward.
