Bond Set For Woman Accused Of Trying To Sell Baby

MIAMI (CBSMiami) – Bond was set at $25,000 for an Opa-Locka woman accused of trying to sell her 5-month old son.

Kenia Bosque, 30, was charged with an adoption violation which is a felony.

In court Tuesday, Miami-Dade Circuit Judge Victoria Brennan set bond higher than the $5,000 guideline due to the depth of the accusation.

"The allegations are that she tried to broker the sale of a child," said Judge Brennan.  "She tried to broker the sale of her own flesh and blood."

"To this court, that callousness raises the level of her dangerousness to the community," said Judge Brennan. "I think there's a heightened dangerousness to Ms. Bosque's actions coupled with the fact that she has ties to other communities that could present her as a flight risk."

Tuesday afternoon, there was a dependency hearing for the baby. The judge awarded temporary custody of the child to Bosque's husband, Osmani Pellegrin, who is not the biological father but has cared for and been part of the child's life since birth.

Pellegrin is the biological father of a 6-year-old daughter and 8-year-old son he shares with Bosque. He and his current girlfriend Mily Vasquez also have a baby girl. They care for that baby and also both older children.

Yoel Boza Alfonso, the biological father of the 5-month old who lives in Key West, was also at the dependency hearing.

Alfonso told CBS4's Peter D'Oench that he and his wife would fight to see the infant and would try to get custody of him.

Alfonso told a judge at the dependency hearing that he had had limited contact with the 5-month-old child. A judge denied his request to see the infant.

"It's real hurtful because when they told me, kids aren't supposed to be sold," said Alfonso.  "I didn't have contact with her.  She had my number, but then I changed it when I moved to Key West."

The judge also said that Bosque would not be able to have any contact whatsoever with her five-month-old child if she is able to post bond, unless the court says that she can.

Bosque was arrested over the weekend after the Monroe County Sheriff's Office received a tip from a confidential informant that Bosque had arranged a meeting with a man to sell her child.

Working with sheriff's office, the Florida Department of Law Enforcement arranged for an undercover agent to take part in the meeting. Bosque, however, failed to show at the arranged time and place.

Fearing for the child's safety, sheriff's deputies and FDLE agents went to Bosque's home and had enough evidence to make an arrest.

This was not Bosque's first run in with the law.  Last month, she along with two other men were arrested in Monroe County after they allegedly tried to steal copper wire from an old shrimp farm on Summerland Key.  The trio was charged with burglary and theft.

Speaking exclusively with CBS4 News, Vasquez and Pellegrin said that all three of her children were home at the time that FDLE agents arrested their mother.

"They do know what happened, the kids know," she said.

In Spanish, Pellegrin said, "My son told me, 'mom tried to sell the baby,' and I told him 'no she was trying to sell the baby's clothes.' To know things like that could make a child sick."

Why would Bosque want to sell a defenseless baby? Her neighbors say she was behind on the rent and facing eviction.

Vasquez said as long as the three siblings stay together- they will pull through this.

"That's the most important thing, 'cause the kids would be affected by being separated from the little baby."
