Eye Doc Linked To Menendez Corruption Back In Court

WEST PALM BEACH (CBSMiami/AP) — Attorneys for a prominent Florida eye doctor linked to New Jersey Sen. Bob Menendez in corruption probe will try to persuade a federal judge to throw out a separate Medicare fraud case against him.

Attorneys for Dr. Salomon Melgen are scheduled Tuesday to argue that prosecutors are misapplying and misinterpreting Medicare law when they say he overcharged the government for certain drugs.

The sweeping indictment against Melgen in Florida is separate from another federal case he faces with Menendez in New Jersey. In Florida, he is accused of an elaborate scheme of falsely diagnosing patients with eye conditions to bill Medicare for costly treatments. In New Jersey, he is accused of trading favors with Menendez to intervene in disputes with Medicare and other matters.

Both men have pleaded not guilty.
