FT LAUDERDALE (CBSMiami/AP) - A woman who reportedly kicked a tied up dog into the Intracoastal Waterway near Boca Raton is facing an animal cruelty charge.

Greg Bunch said he was fishing Sunday night when he saw the dog struggling in the water.

Bunch said Eva Lea Klein, 60, told him her dog loved to swim, but then walked away. Bunch said the dog was continuing to struggle, at which point bystanders used a boat to rescue Jellybean, a toy Lhasa Apso and Shih Tzu mix. When they pulled the dog from the water they found it had been wrapped in wire.

Police traced Jellybean to Klein through the dog's microchip. Klein reportedly told the authorities she would never want to hurt her son's dog.
