TAMPA (CBSMiami/AP) - A man who allegedly shot at a sheriff's deputy near Tampa has been charged with two counts of attempted first-degree murder of law enforcement officer.

Angel Jordanny Rodriguez Aviles, 21, was arguing with his girlfriend Thursday when he fired a shot into the ground when someone tried to intervene.

When Hillsborough County Sheriff's deputies arrived, Aviles and his girlfriend fell to the ground fighting.

Corporal Brian LaVigne saw Aviles had a gun and ordered him to drop it. The sheriff's office said Aviles raised the Glock 23 .40-caliber and fired at LaVigne.

Deputy Michael Diaz and LaVigne both fired back, striking him in the leg. The officers weren't injured.
