Eviction Ends With Gunfire In Miami

MIAMI (CBSMiami) – A man was arrested Tuesday, accused of shooting his tenant during a not-so-smooth eviction process.

Gerard Rivera-Domenech, 40, is behind bars facing multiple charges.

Police responded to reports of a possible shooting at an apartment building on a rough road by I-95 off 79 St. in Miami around noon Tuesday.

According to the police report, when the officer arrived, there was a man with a possible gunshot wound to his right leg. The officer saw Rivera-Domenech walking towards the street from the back of the building. The victim pointed at Rivera-Domenech, saying 'he is the guy that shot me.'

A witness also told police Rivera-Domenech was the shooter.

The officer, according to the report, said that Rivera-Domenech "spontaneously stated" that he shot the victim but that he didn't have the gun anymore.

The victim was transported to North Shore Hospital.

The witness told police that when she got back to her apartment, she saw all belongings were removed from the residence. Rivera-Domenech, the witness reportedly said, had said they were evicted and he had the right to remove their belongings from the residence. She also said that he threatened to shoot shot her as well as the victim.

The weapon was not located at the scene.
