WEST PALM BEACH (CBSMiami/AP) – Attorneys for the Florida doctor charged with corruption alongside New Jersey Sen. Bob Menendez appear to be nearing an agreement to allow his release from jail.

The hearing for Dr. Salomon Melgen ended Monday with no bond granted, but it is set to resume Wednesday when U.S. Magistrate Judge James Hopkins said he hoped to issue an order in the case, which alleges a massive Medicare fraud perpetrated by the eye surgeon. It is separate from a New Jersey case Melgen faces with Menendez.

Though still tentative, prosecutors and the defense in the Florida case have discussed a corporate surety bond for $3 million and personal surety bond of $15 million.

If approved, the agreement would facilitate the 61-year-old Melgen's release after 11 weeks behind bars.
