Canadian Diplomat's Son Seeks Bail

MIAMI (CBSMiami/AP) — The attorney for a Canadian teen facing a murder charge in connection with a drug-related shootout that killed two, including his brother, is seeking his release on bail.

Fifteen-year-old Marc Wabafiyebazu's attorney, Curt Obront, asked a judge Wednesday to set bail for the teen who is charged with murder, and other crimes, in the March 30th shootings.

Obrant said there is scant evidence that Wabafiyebazu fired any shots.

On Wednesday, he appeared in court, hoping to get bail.  His mother Roxanne Dubé, Canada's consul general in Miami was also in court.

Surveillance video captured her 17-year-old son, Jean Wabafiyebazu and Marc arriving at a Coral Way apartment in their mother's car with diplomatic plates.

Jean and Joshua Wright, also 17-years old, were killed in what police said was an attempt by the brothers to rob marijuana dealers.

Marc is seen in the video running into the apartment. He allegedly grabbed one of his brother's guns and fired several rounds.

The defense claims he did this to attract attention and get help. The boy raised his hands in surrender the moment officers arrived at the scene of the shooting.

While he shot no one, he is charged with murder for participating in a crime where someone was killed.

"He just turned 15-years old. He had never been exposed to any aspect of the criminal justice system in his life to be in this situation," said Defense Attorney Curt Obront.

The defense has maintained Marc was just tagging along the day of the killings but a detective on Wednesday described the drug den the two brothers ventured to the day of the shooting.

"A scale that was found inside the apartment. There was also numerous pipes that were located throughout the interior of the apartment as well. There was plastic baggies scattered throughout," said Lt. Carlos Castellanos with the Miami Police Department.

The judge will also hear from a cop who says Marc admitted at the station house that he and his brother went to the apartment with robbery in mind.

His mother is also expected to testify.

Two other young men also are charged in the case.The shooting happened shortly after the brothers left Ottawa, Canada, to join their mother in Miami.
