19-Year Old Accused Of Having Gun At School Faces Judge

MIAMI (CBSMiami) -- A 19-year old student faced a judge on Friday after being arrested the day before for having a gun in school.

A judge allowed Nicole Briana Clark to be released on house arrest with an alternate bond of $15,000. Under house arrest, she will not be allowed to have guns or weapons.

The judge also allowed Clark to seek a GED program since she will be expelled from Green Spring High.

Clark, who has a 2-year-old son, will be allowed to take him to school while under house arrest.

Circuit Judge Mindy Glazer read the charges and the arrest affidavit and said, "It's a very serious charge. I'm going to let you out on house arrest. You're probably going to be expelled from school. You are going to have to make an effort to get your GED. It's very unfortunate."

"Do you have to take your child to school?" she asked.

"Yes," said Clark."

"There are to be no guns or weapons with you as a condition of the house arrest," said Glazer. "She may take the child to school as well."

CBS4's Peter D'Oench spoke with Clark's mother who she lives with. She told D'Oench she did not want to go on camera but said, "Kids should not be toting guns around school."

Miami Police arrested Clark and another 16-year old student on Thursday after there were reports that the pair brought a gun to school.

The school had received an anonymous tip about a 19-year old girl with a gun.

When the principal confronted the girl and checked her purse they found a loaded gun inside.

Investigators said the gun was not hers. They believe the 16-year old boy gave her the gun to hold while they were in school.

The young man and woman claim the gun is not theirs.

According to a new arrest affidavit, Clark said the 16-year-old boy asked to borrow her purse and walked away with it and then returned with it.

She said she had no idea a gun was inside it. The report said witnesses told them an unidentified student gave the 16-year-old student who they say put the gun in the purse.

The arrest affidavit said the gun was a black, Glock pistol that had been stolen in Miramar.

There was also a hearing Friday afternoon at the Juvenile Justice Courthouse for the 16-year-old student. An Assistant Public Defender was appointed to represent him and a not guilty plea was entered on his behalf.

The appearance of both the juvenile and his mother was waived so they were not present for the hearing.

Judge Mavel Ruiz found probable cause in the case and ruled that the 16-year-old student be held in secure detention for 21 days.

There will be another hearing at 9 a.m. on April 8th.

She also said the 16-year-old student has to be enrolled in an alternative school.

Clark is charged with carrying a concealed weapon, possession of a stolen weapon and bringing a weapon on school grounds.

The Principal said neither students nor staff were threatened and said the students will be expelled.  He said the school is conducting an internal review to see how the weapon got past the charter school's metal detectors.
