Family Thankful Police Located Alleged Market Attacker

MIAMI (CBSMiami) - Mohammad Hussein, 58, remains in a coma at Jackson Memorial Hospital as the man accused of sending him to the hospital following an argument at a Miami Beach market appeared before a judge Friday.

Roger Todd Perry is charged with battery in the December 1 incident.  Police tracked him down in Palm Beach.

Police said this surveillance video from inside the "M & L Food Market" in Miami Beach showed Perry backhand Hussein during an argument at a checkout lane.

The father of two fell to the ground hitting his head.

"It's shocking that someone can do this to such a nice guy," said Rayan Huddin, the victim's brother-in-law.  "He's one of the nicest guys you will ever meet basically.  He'll go out of his way to do anything for anyone."

Rayan Huddin is one of about a dozen extended family members who have flown in from out-of-town to be by Hussein's side.

"He's not doing well at all.  He's in critical condition," added Huddin. "The guy just went out to do his shopping, day-to-day, what everyone else does and he could be dead basically.

According to police, Hussein told Perry he was in the wrong checkout line, but Perry continued to unload his groceries and things escalated until Perry backhanded Hussein.

Perry then left the market.

Police searched for him for a week-and-a-half.

Hussein's family is thankful he's been caught.

"We want to thank everyone, especially the media, the police, the public for making sure this man is behind bars and this incident doesn't happen with other people," said Huddin.
