Judge Delays Resentencing Of Jose Padilla
MIAMI (CBSMiami) - The resentencing of Jose Padilla, who was convicted in 2007 of terrorism support and conspiracy charges, has been pushed back.
U.S. District Judge Marcia Cooke on Tuesday moved Padilla's sentencing from August 4th to September 9th. Federal prosecutors and Padilla's defense lawyer sought more time to go through classified evidence Padilla wants to use at a sentencing hearing.
An appeals court ruled that Padilla's original prison sentence of more than 17 years was too lenient.
Padilla was arrested by the FBI in 2002 on what authorities said was an al-Qaida mission to detonate a radioactive "dirty bomb" inside the U.S. But he was never charged with that.
Before trial, Padilla was held without charge as an enemy combatant for over three years.
