Cops Have No Corpse, Man Accused In Wife's Death Wants Out Of Jail

MIAMI (CBSMiami) – A man accused in the death of his estranged wife wants the judge to release him on bond before his trial.

Jesus Maqueira, 55, has denied he killed Raquel Calderin in September 2012. Her body has never been found.

Maqueira and Calderin were married for more than 20 years and had a history of domestic abuse and stalking. Police believe Maqueira even placed a GPS tracking device on his wife's car.

According to the affidavit, Calderin filed for divorce. On September 4the, Maqueira showed up to Calderin's job at Gloria Floyd Elementary School in Kendall to try to get her back.

Calderin left the school early upset by the fight and she has not been seen since.

Prosecutors say cell phone records play Maqueira with Calderin when she disappeared after leaving the school, according to CBS4 news partner The Miami Herald.

Maqueira's alibi for where he was the night Calderin disappeared didn't check out and her family told police that he made cryptic remarks about her death, saying she "would never be found because she was probably dead in a canal."

Prosecutors also have a fellow inmate who will reportedly testify that Maqueira confessed to killing Calderin before dumping her body. The inmate said he stole two letters Maqueira had written in which he confessed to the murder. One was written to God, the other to Calderin, according to the paper.

Monday, Maqueira will challenge the inmate's testimony and alleged evidence and ask Miami-Dade Circuit Judge Eric Hendon to release him on bond.
