Second Lawsuit Filed In Miami Beach Police ATV Crash

MIAMI (CBSMiami/AP) – Another lawsuit has been filed against the city of Miami Beach and former police officer Derik Kuilan who was involved in an ATV crash which seriously injured two people.

On March 30th, a suit was filed on behalf of Luis Almonte who claims he suffered "disability, disfigurement, mental anguish" from the accident.

Kuilan was allegedly drinking at a bachelorette party July 4th, 2009, at the Clevelander Hotel before he reportedly went for a joyride on a police ATV with 28-year Adalee Martin. Driving on the sand on South Beach, Kuilan slammed into Almonte and Kitzie Nicanor, according to authorities.

Almonte suffered a broken leg. Nicanor, who is also suing, suffered a traumatic brain injury.

Martin was also injured when she was thrown from the ATV.

Kuilan, who was fired from the department, is charged with DUI and reckless driving with serious bodily injury.
