Hialeah Man Pleads Guilty To Killing Wife's Reported Lover

MIAMI (CBSMiami) – A Hialeah Gardens man accused of murdering a man with whom his wife was allegedly having an affair has been sentenced to 30 years in prison.

During a hearing on Tuesday, Ricardo Gutierrez changed his plea from not guilty to guilty. He was then sentenced on a reduced charge of second degree murder, according to his attorney Bruce Raticoff. If Gutierrez had not changed his plea, Raticoff said he was facing a life sentence when he went to trial.

Raticoff said Gutierrez is the father of two special needs children and it is tragic that they will not have a life with him.

In 2009, Gutierrez drove to Memorial Hospital in Miramar and waited in his Toyota SUV for 55-year old Antonio Noisette to come out. When he did, police say Gutierrez shot and killed him. Police say Noisette and Gutierrez's wife both worked at the hospital.

Neighbors told CBS4 that the night before the shooting, they saw Gutierrez storm out of his apartment after he had apparently gotten into a fight with his wife. They added that at the time of the shooting, there was some speculation that the couple was in the process of getting a separation.
