Ultrasound Tech Sent To Prison For Sex Assault On Patient

FORT LAUDERDALE -- (CBS4) -- An ultrasound technician who sexually assaulted a female patient while he performed the routine exam will begin serving his five year prison sentence and later serve 12 years of sex-offender probation, according to a plea agreement.

Ivo Diaz, 43, agreed to enter a guilty plea in exchange for the sentence which was read in a Broward County courtroom Friday morning.

Diaz who had three charges of sexual battery for the incidents that occurred in 2009 at Holy Cross Hospital in Fort Lauderdale was looking at a maximum sentence of 45 years in prison.

But since the victim in the case refused to testify in court, Diaz was offered the state's plea deal.

In 2009, Diaz assaulted the woman three times during the ultrasound, which should have been performed in the presence of another female employee, according to hospital rules.
